1. Acceptance of These Terms

ENGINORD Oy (“ENGINORD”, “we”, “us”, “our”) is the data controller responsible for the personal data described in this privacy policy.

This privacy policy applies to personal data processed in connection with www.enginord.com and related business interactions including contact and early enquiries, subscriptions to ENGINORD Insights, and expressions of interest in joining ENGINORD's expert network.

It does not apply to (i) third-party websites linked from our site, which have their own privacy practices, or (ii) personal data ENGINORD processes as a data processor on behalf of a client under a specific engagement, such processing is governed by the relevant client contract and, where applicable, a separate data processing agreement.

3. Changes to These Terms

We may revise these Terms from time to time by posting an updated version on the Site with a new “Version dated” notice. Changes take effect once posted. Your continued use of the Site after a change takes effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Site.

We may also update, suspend or discontinue all or part of the Site, including any feature or Content, at any time and without notice or liability.

4. Website Content and Intellectual Property

The Site and its content, including text, graphics, logos, diagrams, images, video, and the underlying design (the "Content"), is owned by ENGINORD or its licensors and is protected by copyright, trade mark and other intellectual property laws. Except as expressly permitted below, no part of the Content may be reproduced, distributed, modified, publicly displayed, or used to create derivative works, without ENGINORD's prior written consent.

Where Content on the Site discusses, summarises or quotes third-party sources — for example, in our Insights articles, that underlying material remains the property of its respective owners. ENGINORD's ownership under this clause extends to our own original text, analysis and commentary, and to the selection and arrangement of Content on the Site, not to the facts, quotations, or source material we reference. Short quotations are used under applicable copyright exceptions (such as quotation or fair dealing) with clear attribution and, where possible, a link to the original source. Any third-party names, logos or trade marks referenced in our Content belong to their respective owners; their use is for identification and commentary purposes only and does not imply any endorsement of, or affiliation with, ENGINORD.

You may view, download and print pages of the Site for your own personal, non-commercial reference, provided you do not modify the Content and you keep all copyright and other proprietary notices intact.

You must not use the Content for any commercial purpose, or republish, redistribute or syndicate it to any other website or medium, without our prior written permission.

ENGINORD's name, logo, and any related marks are the trade marks of ENGINORD. Nothing on the Site grants any licence or right to use them without our prior written permission.

5. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose, or in a way that infringes the rights of, restricts, or inhibits anyone else's use of the Site.

• Attempt to gain unauthorised access to the Site, its servers, or any systems or networks connected to it, including by hacking or password mining.

• Interfere with or disrupt the operation of the Site, or introduce any virus, malware or other harmful material.

• Submit false, misleading or fraudulent information through any form on the Site.

We reserve the right to restrict or terminate your access to the Site, without notice, if we reasonably believe you have breached these Terms.

6. No Text or Data Mining, or Use for AI Training

You must not conduct, facilitate, authorize or permit any text or data mining, web scraping, or other automated extraction of the Site or its Content, including through any “robot”, “bot”, “spider”, “scraper” or similar automated tool for any purpose, including the development, training, fine-tuning or validation of any artificial intelligence system or model.

This clause is an express reservation of ENGINORD's rights for the purposes of Article 4(3) of the Digital Single Market Directive ((EU) 2019/790) and any equivalent provision under applicable law, and applies only to the extent we are legally able to reserve such rights by contract.

7. Linking to Our Site

You may link to the Site's home page, provided you do so in a way that is fair, lawful, and does not damage or take unfair advantage of ENGINORD's reputation. You must not frame the Site within another website, or suggest any affiliation, endorsement or approval by ENGINORD where none exists. We reserve the right to withdraw linking permission at any time.

8. Third-Party Links and Content

The Site may contain links to third-party websites, such as LinkedIn or partner sites, provided for your convenience only. We do not control, and are not responsible for, the content, accuracy or privacy practices of any third-party website, and inclusion of a link does not imply our endorsement. Use of any third-party website is at your own risk and subject to that website's own terms.

9. No Professional Advice

The Content on the Site, including descriptions of ENGINORD's scope of work, methodology, and any Insights articles or expert commentary is provided for general informational purposes only. It does not constitute, and must not be relied upon as, professional, technical, engineering, safety, legal, financial or regulatory advice.

Any engagement of ENGINORD's advisory services is governed exclusively by a separate, signed agreement between ENGINORD and the client, the terms of which will take precedence over any general information published on the Site.

10. Disclaimer of Warranties

The Site and its Content are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including to the fullest extent permitted by law implied warranties of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement. ENGINORD does not warrant that the Site will be uninterrupted, timely, secure, or free of errors or viruses.

11. Limitation of Liability

To the fullest extent permitted by applicable law, ENGINORD shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or in connection with your use of, or inability to use, the Site or its Content, even if ENGINORD has been advised of the possibility of such damages.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable Finnish or EU law, including liability for death or personal injury caused by negligence, or for fraud.

12. Privacy and Cookies

Our collection and use of personal data through the Site is described in our Privacy Policy, and our use of cookies and similar technologies is described in our Cookie Policy. Both documents form part of these Terms by reference. Please read them alongside these Terms.

13. Governing Law and Jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or the Site, shall be governed by the laws of Finland, without regard to its conflict-of-laws principles.

Any dispute shall be settled by the competent Finnish court, with Länsi-Uudenmaan käräjäoikeus (the Western Uusimaa District Court, seated in Espoo) as the court of first instance, unless mandatory consumer-protection law provides otherwise.

14. Severability and General

If any provision of these Terms is found unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity of the remaining provisions.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and ENGINORD regarding use of the Site, and supersede any prior understanding relating to the Site. No waiver of any provision shall be treated as a further or continuing waiver.
